Terms of Use

Effective October 10, 2026

These terms are an agreement between you and Cabral Inc. (“Cabral”, “we”, “us”) for the Pombers app and pombers.com (together, “Pombers”). By downloading or playing Pombers you agree to them. If you don’t agree, please don’t use Pombers. Our Privacy Policy explains how we handle your information.

1. Who can play

You must be at least 13 years old, or the minimum age to use online services where you live if that’s higher. If you’re under 18, your parent or guardian must agree to these terms for you.

2. Your account

You can play practice games without an account. To play ranked matches, the daily challenge and with friends, you sign in with Apple. Your account is for you alone; you’re responsible for what happens on it. We assign your player name, and you can change its adjective in the app.

3. Fair play

Pombers is a game of quick hands, and it only works if everyone plays it themselves. You agree not to:

• use bots, scripts, macros, auto-tappers or any automated play;
• use a modified version of the app, tamper with what it sends, or exploit bugs to gain an advantage — please report bugs to us instead;
• interfere with Pombers or its servers, or try to reach information that isn’t yours;
• copy, decompile or reverse engineer the app, except where the law allows it;
• harass other players, for example by flooding them with invitations or challenges.

We check every counted game automatically. If we believe a game or an account isn’t fair play, we may withhold or remove points, void matches, leave the account out of leaderboards, or suspend or close it.

4. Points and leaderboards

Points, ranks and records are part of the game. They have no money value, can’t be bought, sold or transferred, and we may adjust or reset them — for example to fix a mistake or after a change to the game.

5. Ad‑free and other purchases

Ad‑free is a one-time purchase made through Apple’s App Store and governed by Apple’s terms. It removes the ads Pombers shows; it doesn’t change how the game plays. Prices are shown in the app before you buy. Refunds are handled by Apple under its policies. If you reinstall Pombers or get a new device, use Account → Restore Purchase with the same Apple Account.

6. Ads

The free version of Pombers shows ads from third parties through Google AdMob. We don’t control the content of ads or the sites and apps they lead to, and we aren’t responsible for them.

7. Our content and your licence

Pombers — its name, characters, artwork, sounds and software — belongs to Cabral Inc. We give you a personal, non-exclusive, non-transferable, revocable licence to download and use the app for your own entertainment on Apple devices that you own or control, as allowed by the Usage Rules in Apple’s Media Services Terms and Conditions.

8. Changes to Pombers

Pombers is a live game. We may add, change or remove features, rules and modes, and we may suspend or stop offering Pombers, with or without notice.

9. Ending the agreement

You can stop playing at any time and delete your account in the app (Account → Delete Account). We may suspend or end your access if you break these terms or if we stop offering Pombers. Sections 4, 7, 10, 11, 12 and 13 continue to apply afterwards.

10. Disclaimers

Pombers is provided “as is” and “as available”. To the extent the law allows, we make no warranties of any kind, express or implied — including that Pombers will be uninterrupted, error-free, or that results, points or rankings will always be recorded. Live matches depend on your connection and other players’ connections.

11. Limitation of liability

To the extent the law allows, Cabral Inc. won’t be liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, points or profits. Our total liability for any claim about Pombers is limited to the greater of the amount you paid us in the 12 months before the claim, or US$50. Some places don’t allow these limits, so they may not apply to you; nothing in these terms limits rights you have under consumer law that can’t be waived.

12. Governing law

These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules, and disputes will be heard in the state or federal courts located in Wyoming — unless the law where you live gives you the right to bring a claim in your local courts or under your local law.

13. Apple

If you got Pombers from Apple’s App Store:

1. These terms are between you and Cabral Inc. only, not Apple. Cabral Inc., not Apple, is solely responsible for Pombers and its content.
2. Your licence to use Pombers is limited to Apple-branded products you own or control, as allowed by the Usage Rules in Apple’s Media Services Terms and Conditions; Pombers may also be used by other accounts in your Family Sharing group as those rules allow.
3. Apple has no obligation to provide any maintenance or support for Pombers.
4. If Pombers fails to conform to any warranty that applies, you may notify Apple, and Apple will refund the purchase price, if any, to you. To the maximum extent the law allows, Apple has no other warranty obligation for Pombers; any other claims, losses, liabilities, damages, costs or expenses from a failure to conform to a warranty are Cabral Inc.’s responsibility.
5. Cabral Inc., not Apple, is responsible for addressing any claims by you or a third party relating to Pombers or your possession and use of it, including product liability claims, claims that Pombers fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
6. If a third party claims that Pombers or your possession and use of it infringes their intellectual property rights, Cabral Inc., not Apple, is solely responsible for the investigation, defense, settlement and discharge of that claim.
7. You confirm that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
8. You must comply with any third-party terms that apply when you use Pombers, such as your mobile data agreement.
9. Apple and its subsidiaries are third-party beneficiaries of these terms, and once you accept them Apple has the right (and is deemed to have accepted the right) to enforce them against you as a third-party beneficiary.

14. Changes to these terms

We may update these terms. We’ll post the new version here with a new effective date, and tell you in the app if a change is significant. If you keep playing after a change takes effect, you accept the new terms.
